A consumer is entitled to called on Schlichtungsstelle Energie e. V. (arbitration board) pursuant to sec. 111b EnWG (German Electricity and Gas Supply Act) to perform arbitration if the company does not remedy the complaint within the processing period or has declared that they will not remedy the complaint. Sec. 14 para. 5 VSBG (German Consumer Dispute Resolution Act) remains reserved. The company is obligated to participate in the arbitration process. The submission of a complaint to the arbitration board suspends the statute of limitations pursuant to sec. 204 para. 1 no. 4 BGB (German Civil Code). Participants’ rights to bring the matter to the court or request another procedure remains reserved.
